These Terms of Service ("Terms") govern your use of havershamsolutions.com and the services of Haversham Solutions, T1 3rd Floor, Wthite Field Apts, C101 Crescent Road, Thiruvengadnagar, Ambattur, Chennai, Tamil Nadu 600053, India ("we", "us"), including our SaaS Master app. By using the website or our services you agree to these Terms. If you act for an organisation, you confirm that you may accept these Terms on its behalf.

Our Services

We provide technology services including websites, digital campaigns, messaging and workflow automation, CRM and scheduling setup, knowledge assistants, dashboards and custom business applications. Paid work is described in a written proposal or agreement; where it differs from these Terms, that agreement applies.

Accounts

• Provide accurate information and keep sign-in details confidential.
• You are responsible for activity under your organisation's accounts and for the roles you give your staff.
• Tell us promptly at contact@havershamsolutions.com if you suspect unauthorised access.

Acceptable Use

You must not use our services to send spam or messages to people who have not agreed to hear from you; to break the law or infringe the rights or privacy of others; to upload malware or interfere with our systems; to attempt to access another customer's data; or in breach of the WhatsApp Business Terms of Service, the WhatsApp Business Messaging Policy or Meta's Commerce Policy. We may suspend access that we reasonably believe breaks these rules or puts others at risk.

Business Messaging

The SaaS Master app connects to the WhatsApp Business Platform operated by Meta. Availability, message delivery and Meta's charges are governed by Meta's own terms and may change. Automated replies are supervised: your organisation remains responsible for what it sends, for obtaining any required opt-ins and for responding to its customers.

Your Data

You keep ownership of the data you give us. You allow us to process it only to provide, secure and support the services, as described in our Privacy Policy, and you confirm you have a lawful basis to share any personal data of your customers.

Fees

Fees are agreed in writing before work or billing begins and exclude applicable taxes. Third-party costs, such as platform fees, messaging charges, AI usage and advertising spend, are listed in the proposal and may be billed separately.

Intellectual Property

We keep all rights in our software, tools and website content. Rights in work created specifically for you are set out in the agreement for that work.

Availability

We work to keep our services reliable but do not promise uninterrupted or error-free operation. Support levels apply only where agreed in writing.

Disclaimer And Liability

To the extent permitted by law, the website and services are provided "as is" without implied warranties, and we are not liable for indirect or consequential losses or loss of profits, revenue or data. Our total liability in any twelve-month period is limited to the fees you paid us for the affected service in that period.

Ending The Service

You may stop using our services at any time. We may suspend or end access for a serious breach of these Terms. After an account ends we will make your data available for export for a reasonable period and then delete it, unless the law requires us to keep it.

Governing Law

These Terms are governed by the laws of India. The courts at Chennai, Tamil Nadu have exclusive jurisdiction over disputes arising from them.
